1) Overview of CE certification

In the European Economic Area, the CE marking can be seen on a variety of products. It shows that the product meets the corresponding safety, health and environmental protection requirements. CE marking in the EU market is a compulsory certification mark, all products within the scope of the New Approach Directive that require CE certification are within the scope of CE certification products, and certification is required to show that the product meets the basic requirements of the EU "New Method Resolution for Technical Harmonization and Standards" directive. The "essential requirements", which form the core of the European Directives, are specifically defined in the EC Decision on New Methods for Technical Harmonization and Standards of 1985 May 5, i.e. limited to the basic requirement that the product does not endanger the safety of humans, animals and goods, and not to general quality requirements. Therefore, the CE certification mark is a safety mark rather than a quality mark.

Turkey adopts European standards in imports, while adopting CE marking certification. According to the Turkish Regulation No. 2001/3530 on the Affixing and Use of the CE Conformity Mark on Products and related legal provisions, when importing products within the scope of the EU New Approach Directives into Turkey from abroad, importers need to provide CE testing and certification conformity certificates to customs, and CE marks must also be displayed on the goods. If there is no cE mark, Turkish Customs requires the exporter to provide a product inspection report certifying compliance with cE certification, and send the sample of the goods to the Turkish Standards Agency (TSE) for inspection, and only after meeting the relevant standards will the customs clearance be permitted. Up to now, the Turkish government has announced that products within the scope of the EU New Approach Directives, as long as they are tested for cE certification in accordance with the relevant EU directives, in accordance with the corresponding European harmonized standards, have obtained third-party certification or self-declaration, and affixed CE marks as required, can successfully pass Turkish customs and enter the Turkish market. However, in practice, the phenomenon of cE-certified products originating outside the EU still exists, which creates unfair competition between EU products and products from other countries entering Turkey.

 

2〉Products that Turkey requires cE certification

In general, products that require CE certification can be divided into the following 4 categories:

1. The relevant product directives clearly require cE certification. 2. New types of products produced within the EU or in third countries. 3. Second-hand goods imported from third countries. 4. Products subject to the Directive have undergone major changes or other changes that should be considered as new products

Every year, the list of products and import rules that require CE marking are revised in Turkey and published in the Official Gazette. The Official Gazette is available at http : / /www.resmigazete.gov.tr/ default. aspx# for consultation.

3) CE certification and access procedures

CE certification itself consists of 6 steps:

Turkey will also refer to its own harmonized standards when conducting CE certification assessment, which can be viewed by clicking the standards link under the corresponding product entry on the harmonization directive page. The Turkish Harmonization Directive page is available at: https :

products, so the cE certification procedure is also different. For products with high safety risks, the CE marking should be affixed only after the government of the Member State authorizes the designation of a qualified third-party independent organization to conduct safety testing.
The Turkish Ministry of Industry and Trade directly adopts the guidelines of the EU's New Approach Directives in the conformity assessment guidelines, and stipulates different conformity assessment procedures according to the severity of the safety risks of the product. According to the provisions of the Turkish CE Marking Product Import Bulletin No. 2004/9 and No. 2004/22, the conformity certification carried out by "self-declaration" and "carried out by the notified body" is assessed in the following way:
a. Self-declaration If the EU directive stipulates that a product can be subject to self-declaration conformity assessment mode, the manufacturer or an authorized representative of the manufacturer should ensure and declare that the product meets all relevant directive requirements and is required to issue a "declaration
of conformity". Affix the CE mark to each product; Copies of declarations of conformity, test reports, other technical documents are kept for inspection by the Turkish supervisory authorities.

In this case, the importer should submit a declaration of conformity and a technical report of testing to TSE at the import stage, and TSE will confirm the conformity of its products, TSE may request to re-test the product, and if it proves that the relevant regulatory and standard requirements are met, TSE will issue a confirmation letter. Importers can enter the Turkish market by submitting the confirmation letter from TSE to customs.
b. For products with safety risks,
the EU Directive stipulates that an authorized notified body must inspect the product in accordance with the EU Directive and relevant technical standards and issue a conformity report/certificate.
The EU stipulates that governments are responsible for authorizing and supervising competent Notified Bodies. Only legal entities established in the territory of Member States are eligible to become Notified Bodies. Turkey has only regulations on conformity assessment bodies and Notified Bodies, and since it has not yet become a full member of the European Union, it does not yet have a Notified Body. If the product testing and quality control of the production process must be supervised and inspected by a designated Notified Body, it is sufficient to choose a Notified Body published by any EU Member State, and its certification mode and procedures are the same as those of the relevant EU directives.
If the product has obtained the CE certification certificate of the "Notified Body" before import, the certificate is submitted directly to the customs, and the customs can clear customs after verifying that it meets the regulations. If in doubt, the TSE will carry out the inspection.

 


Regulation Mo.4/2001, Regulation on the Affixing of the CE conformi Marking on the Product, as amended by Resolution 3530/2011 The general requirements for affixing the cE conformity mark are as follows:
The CE marking indicates that the product meets all the requirements of the technical regulations that the producer needs to comply with to affix the cE mark. If a product is subject to multiple regulations requiring the cE mark, the use of the cE mark indicates that the product complies with all of these regulations. If the relevant regulations provide additional requirements in addition to the basic requirements, the cE marking indicates that the product also meets these special requirements.
· The CE marking indicates the manufacturer's guarantee and symbol of compliance with all relevant requirements for his product, while stating that the product complies with the necessary conformity assessment procedures.
。 Products are subject to multiple technical regulations, and CE identification indicates that the product meets the requirements of all regulations. If, during the transition period, one or more technical regulations allow producers to choose the arrangement for the application of the regulations, the cE marking indicates that the product only meets the requirements of the technical regulations applied by the producer. In this case, the applicable regulations shall be indicated on the documents, notices, instructions accompanying the product or in the appropriate place on the nameplate.
。 The use of the CE marking should comply with the regulations
. No conformity mark other than the cE mark should be affixed to the product to prove that the product complies with the technical regulations. The cE mark
is affixed at the final stage of production control. The CE marking is affixed by the producer. If required by regulations, the cE mark shall indicate the identification code of the authorized Notified Body, and the attachment of the Notified Body Identification Code shall be the responsibility of the Notified Body itself or the producer.
。 If it is necessary to regulate the use of certain products, other graphics or logos may be used in addition to the cE mark and the Notified Body Identifier to indicate the type of use of the product.
。 The use of other marks that may mislead third parties or as to the meaning and composition of the cE mark is not permitted.
