Introduction to the Mandatory Conformity Assessment Procedure (SONCAP) SONCAP is a new policy implemented by the Federal Government of Nigeria to control the export of non-conforming unsafe products to

the country.

SONCAP came into effect on 1 September 2005 with a 90-day grace period, i.e. effective 1 December 2005.

SONCAP is an acronym for Standards Organization of Nigeria Conformity Assessment Programme.

SONCAP is a set of conformity assessment and certification procedures applicable to certain categories of regulated products imported into Nigeria. The above regulated products must meet or comply with the requirements of the Nigerian Industrial Standards (NIS) and/or other approved international standards prior to shipment.

SONCAP was implemented to protect Nigerian consumers from unsafe and/or substandard manufactured goods. Most of the above-mentioned unsafe products are imported goods and sold directly to consumers.

The goal of implementing SONCAP is to ensure that regulated products meet the relevant requirements of acceptable standards and to facilitate the management of regulated products by relevant government agencies with regulatory responsibility for product quality.

An overseas activity does not replace any statutory duties of the Standards Authority of Nigeria (SON);

A certification that must be carried out for regulated products;

Ensure that regulated products comply with the relevant provisions of Nigerian industrial standards or other 5 approved international standards;

Ensure that the examination process includes the following factors:

identification of laboratory use;

the scope of the experiments conducted;

Verify the validity and authenticity of the report.

SONCAP Compliance Procedures

SONCAP requires a two-step statutory certification process for product quality to ensure that the product meets specific standards such as NIS, ISO, BSI, IEC, etc.

The two-step process includes: 1. Product Certification:

product certification;

2, SONCAP Certification: SONCAP mandatory certification.

The first step of product certification is only applicable to the first export to Nigeria of a particular category of controlled products. Exporters who have passed product certification will receive a Product Certificate, which is valid for three years. After that, you can apply for the opening of Form "M".

The second step, SONCAP, is mandatory certification, which applies to a certain batch of pre-shipment cargo.

SONCAP Certificate (SONCAP Certificate) is a statutory necessary document for controlled products to go through customs clearance procedures in Nigeria Customs, and the lack of SONCAP Certificate will cause delays in customs clearance of controlled products or may be refused entry into customs. It is important to note that in addition to product certification and SONCAP compulsory certification, controlled products must be accompanied by any other existing import procedures, such as pre-shipment inspection (PSI). In other words, product certification and SONCAP compulsory certification procedures are not a substitute for any other existing import procedures required by the Nigerian government.

SONCAP offers exporters of regulated products two ways to obtain a SONCAP certificate. Exporters can determine their choice according to their own circumstances.

The first method, called Substantiated Declaration, is for exporters whose products are fully compliant with Nigerian standards and regulations. The exporter is required to submit a Test Report and a Request for Product Certification (RFPC) to the Nigerian National Bureau of Standards office in the exporting country prior to loading the goods.

After the inspection report is approved, the importer will obtain a product certificate, which is valid for up to three years, calculated from the date of issuance of the inspection report. Thereafter, before each batch of controlled products is loaded on board, the exporter must submit a completed Request for Shipment Certification and a Final Invoice to the Office. The SONCAP certificate will be issued to the exporter for customs clearance.

The second method, called Unsubstantiated Declaration, is for exporters who cannot submit a substantiating test report. The exporter must contact the office, which provides the exporter with the contact details of an authorized laboratory capable of testing a particular regulated product. After passing the product inspection, the exporter must submit a test report and a request for product certification (RFPC, see attached table) to the office.

After the inspection report is approved, the importer will obtain a product certificate, which is valid for up to three years, calculated from the date of issuance of the inspection report. Thereafter, before each batch of controlled products is loaded on board, the exporter must submit a completed Request for Shipment Certification and a Final Invoice to the Office. The SONCAP certificate will be issued to the exporter for customs clearance.
